California Sues EPA Over CO2 Standards
The state of California filed a lawsuit against the Environmental Protection Agency on Wednesday for denying its attempt to set its own emissions standard. California was one of several states recently denied the necessary waiver to enact its own policy under the Federal Clean Air Act.
EPA head Stephen Johnson denied the California waiver on December 19, saying that one whole federal regulation would be more effective than many different state laws.
Setting the tone early for the lawsuit, California Attorney General Jerry Brown said, “There's absolutely no justification for the administrator's action.

Go EPA. I don't want California dictating (in practice) to automakers what they can sell to the rest of us.

California may be a bit extreme. I think federal laws make more sense than many state laws. It would put a lot of pressure on automakers if California succeeds.

It is not just California Dudes. 11 other states use the same standard. I do not think the manufacturers are building seperate vehicles for each state. They are building them all to the strictest standrd now.
Didn't SCOTUS rule that states do have the right to set they're own standards under the implied powers provision?

Some manufacturers do sell different cars or engine tunes depending on the states. The car companies will most likely comply with whatever CA does as it's as big a market as a 1st-world country.

I think the entire "lawsuit" thing is a grand stand play by Jerry Brown. He is about as extreme left wing as politician in the US. I think there is a difference between an individual state asking for stricter standards on polutants already being regulated, and demanding that manufacturers control a new substance that hasn't been proven to be a pollutant. How do you put controls on co2 emmissions? Maybe we could pass a law making it illegal for people to exhale!
